Nuevos dueños de la energía: cuáles son los nombres que se reparten el negocio estrella del modelo macrista (iProfesional)   


Las inversiones en producción y transporte de gas y electricidad se suceden mientras crece la lista de empresarios que apuestan por un segmento antes alicaído. La decisión oficial de avanzar con las centrales nucleares eleva las expectativas. Los protagonistas que picaron en punta en un nicho clave


El atractivo volvió con el cambio de Gobierno, casi de forma automática. En medio de promesas de políticas orientadas a sumarle valor a la producción y transporte de los insumos, y una modificación en el esquema de tarifas, el segmento energético rápidamente derivó en un magma de inversiones, compras y ventas.

Y comenzaron a aparecer nombres de empresarios y compañías que entendieron al nuevo clima político como un escenario de oportunidades.

De Marcelo Mindlin a Eduardo Eurnekian, pasando por la familia Werthein y más de un "tapado", un estamento de inversores nacionales movió rápido sus fichas para hacer de la energía una opción de rédito en alza. Para el Gobierno, cada uno de las apuestas que llevan adelante hombres y compañías locales representa otra forma de atraer el interés internacional.


"Que empresarios como Mindlin lleven a cabo compras de envergadura, o que se conozcan inversiones de relevancia en el sector, es una manera de reposicionar a la Argentina en el mapa de los mercados atractivos. Son acciones que nos vuelven competitivos", sostuvo ante iProfesional una fuente cercana al ministro Juan José Aranguren.

En torno a los equipos oficiales predomina el optimismo ante una perspectiva positiva dada la riqueza que posee la Argentina en combustibles como el gas o el aprovechamiento que todavía queda por realizar en lo que hace a la generación hidroeléctrica.

"Tenemos una situación auspiciosa en energía. Tras algo más de 15 años de malas decisiones, hay un interés creciente de los privados, sobre todo en la producción y el transporte del gas. También interesa la distribución de la electricidad. En ese sentido, Mindlin está marcando el ritmo por ser unos de los primeros que entendió que hay que apostar por el sector energético", comentó a iProfesional Emilio Apud, asesor de Cambiemos y actual director en YPF.

Para el experto, las compras y ventas de los últimos meses muestran que el empresariado ha dejado de "sufrir las inseguridades que generó el kirchnerismo". Al respecto, destacó al gas como el activo que marcará los tiempos de la inversión en el mediano plazo.

"La electricidad es importante y un negocio de relevancia, pero el gas es el futuro energético de la Argentina y el mundo. Esto lo están entendiendo empresarios como Eurnekian, que prefieren resignar posiciones en la distribución para direccionar los esfuerzos a la extracción del combustible", ejemplificó.

Justamente la expectativa que genera el futuro mayor consumo de gas es la variable que mejor explica el permanente interés por invertir en Vaca Muerta, en la provincia de Neuquén, que vienen sosteniendo compañías internaciones como Chevron, Shell, Petronas o Dow, además de la estatal YPF.

Mindlin, en punta
Si hay un auténtico protagonista del segmento tras la irrupción de Cambiemos, ese es Marcelo Mindlin. El mercado energético, ahí donde supo hacerse fuerte en tiempos de otro viento político, sigue siendo su principal ámbito de apuestas.

De ahí que, en mayo del año pasado, la compra de los activos de la brasileña Petrobras en la Argentina a través de Pampa Energía lo colocó en el pelotón de los que deciden el escenario de las naftas a nivel nacional.

Y algo más: la operación también le aseguró el control de más de 30 reservas hidrocarburíferas, una red de estaciones de servicio, dos instalaciones petroquímicas y hasta una refinería ubicada en la ciudad bonaerense de Bahía Blanca.

Hoy por hoy, Mindlin genera casi el 10% del gas que se produce en la Argentina.

Al mismo tiempo, mantuvo su participación en CIESA, la compañía que controla los destinos de TGS, considerada la mayor transportadora de gas doméstica. En tanto, septiembre del año pasado fue el mes elegido para la compra, previo desembolso de u$s100 millones, del 100% de Albares Renovables Argentina, adjudicataria de licitaciones gubernamentales en materia de energía térmica.

Dueño de Edenor, Mindlin posee más de 20.000 kilómetros de líneas de provisión de energía al controlar las firmas Transener y Transba. En paralelo, el titular de Pampa es un "peso pesado" de la generación dado que posee las hidroeléctricas Los Nihuiles y Diamante, y las centrales térmicas Loma de la Lata, Piedrabuena y Güemes.

A través de la compra de la ex IECSA -rebautizada Sociedad Argentina de Construcción y Desarrollo Estratégico (SACDE)- a Ángelo Calcaterra, primo de Mauricio Macri, Mindlin también se hizo con un activo que le abre las puertas del renovado negocio de la energía nuclear. SACDE ya participa de la licitación para la construcción del edificio donde se desarrollarán los reactores CAREM en Lima, provincia de Buenos Aires, y también podría salir a pelear contratos para lo que será el diseño de Atucha III.

"Tiene un auténtico ejército de ingenieros con todas las especialidades posibles. Es una empresa en permanente expansión, por lo que de seguro también estará entre las candidatas a las principales obras", comentó una fuente vinculada al Ministerio de Energía.

Siempre Caputo
Otro de los nombres que pisa fuerte en el ámbito energético es el de Nicolás Caputo. De la mano de SADESA, participa en la generación de electricidad a través de Central Puerto y Central Mendoza. También posee participación en distribuidoras de gas en el centro del país y la región de Cuyo.

Al mismo tiempo, Caputo cuenta con una porción muy amplia en Edesur adquirida a la brasileña Petrobras en enero de 2013. En ese momento, la petrolera vendió su participación del 48,5% en u$s35 millones. Dichas acciones las adquirieron Hidroeléctrica Piedra del Águila (HPDA) y La Plata Cogeneración, ambas bajo control de SADESA.

En enero de 2017, la firma presentó proyectos para levantar una planta de ciclo combinado de 1.600 megavatios en el complejo industrial de Zárate y Campana. En simultáneo, el empresario ha triunfado en algunas de las principales licitaciones que el Gobierno llevó a cabo en materia nuclear.

Por poner un caso, a principios de este año se quedó con la construcción de un sistema de almacenamiento en seco de combustibles atómicos para la central de Atucha I. La obra está valuada en algo más de $500 millones.

Ya en enero de 2016, Caputo se alzó con la construcción de la obra civil de los edificios del reactor RA-10, en un contrato valuado en casi $800 millones. Al momento de informar los resultados de la compulsa, la CNEA argumentó en un comunicado que el empresario obtuvo "la ejecución del proyecto de diseño, construcción y puesta en marcha del reactor de investigación multipropósito RA-10, fundamentalmente, para aumentar la producción de radioisótopos destinados al diagnóstico de enfermedades".

Por estos días, Caputo está entre los finalistas de la competencia por la obra civil del edificio que albergará a toda la producción de CAREM. El presupuesto para dicho emprendimiento alcanza los $1.300 millones.

Pagano: el tapado
Más allá del despliegue de Mindlin y el movimiento creciente de Caputo, una de las movidas más significativas en tiempos de macrismo corrió por cuenta de un "tapado": Rogelio Pagano, un empresario del "riñón" del titular de Pampa Energía y que a fines de mayo de 2016 compró una serie de compañías que lo transformaron en una suerte de "zar" de la electricidad bonaerense.

En ese momento, el empresario pagó u$s250 millones para quedarse con Edelap, la firma que brinda electricidad a más de 400.000 usuarios en La Plata y su área de influencia, además de garantizarse también el dominio de EDEA, la empresa que provee de suministro a casi 530.000 clientes en Mar del Plata.

Al frente de Desarrolladora Energética (DESA), Pagano también opera EDESA, clave en la provisión de electricidad en la provincia de Salta, y las distribuidoras EDEN y EDES, con operaciones en el centro y sur de la provincia de Buenos Aires.

Pagano no es ningún improvisado en el negocio energético: integró el directorio de Edenor entre 2005 y 2012 y acompañó a Mindlin en Pampa Energía durante varios años. También ocupó diferentes cargos en Citibank y Bank Of America. Producto de sus últimas maniobras, Pagano pasó a disponer de una cartera de usuarios que supera con comodidad los 1,5 millones de clientes.

Macfarlane y Werthein
La venta de Edelap a Pagano corrió por cuenta de otro "viejo" conocido de Mindlin: Alejandro Macfarlane, titular del grupo Disvol y también con pasado en Pampa Energía.

A principios de mayo de este año, Macfarlane hizo un uso concreto de los fondos que recibió del actual dueño de Edelap al cerrar la compra del 31,5% del capital social y los votos de Camuzzi Gas Inversora, controlante de Camuzzi Gas Pampeana y su homónima Gas del Sur CGP.

Camuzzi Gas Pampeana distribuye gas natural a 1,3 millones de clientes residenciales e industriales en las provincias de Buenos Aires y La Pampa. En tanto, Camuzzi Gas del Sur asegura el suministro a 650.000 usuarios en toda la Patagonia.

Otro actor que se sumó en el último tiempo corresponde a la familia Werthein, que a mediados del año pasado generó una de las mayores sorpresas del segmento tras desembolsar unos u$s240 millones por la mitad de CIESA, la compañía que controla TGS y aún cuenta con participación de Mindlin.

"Se trata de una empresa que, sin problemas, debería facturar por los menos unos $3.500 millones anuales. Capacidad industrial no le falta", comentó a este medio una fuente cercana al ministro Aranguren.

La compra de TGS les aseguró el control del principal distribuidor de gas domiciliario y para complejos industriales, con monopolio del fluido que proviene principalmente de la cuenca Austral.

Asimismo, la firma es la mayor procesadora de líquidos derivados del gas, actividad que la compañía desempeña en la planta que posee muy cerca de Bahía Blanca, en la localidad de General Daniel Cerri.

En concreto, TGS produce a razón de 300.000 toneladas de etanol, 550.000 de propano y butano, además de 150.000 de naftas. Las principales productoras químicas de la Argentina operan en vínculo con la transportadora, que además cuenta con una potente instalación de poliductos en Puerto Galván, siempre en el sur de la provincia de Buenos Aires.

Eurnekian, en retirada
La contracara de estas expansiones corresponde a Eduardo Eurnekian, que en los últimos meses hizo evidentes sus movimientos para salir de Transportadora Gas del Norte (TGN).

A través de Compañía General de Combustibles (CGC), el empresario posee la mayoría accionaria de Gasinvest, controlante de la transportadora.

TGN cuenta con una de las mayores redes de gasoductos de la región, con una extensión que alcanza los 6.000 kilómetros distribuidos mayormente en el centro y norte de la Argentina. Ocho distribuidoras, diversas generadoras y múltiples industrias dependen del fluido que acerca este entramado de alcance nacional. El negocio de la firma está valuado en algo más de u$s750 millones.

La retirada de Eurnekian no concluye ahí: a mediados de mayo intensificó las conversaciones con Gas Natural Fenosa, controlante de Gas Natural BAN, para transferirle su participación en el gasoducto GasAndes, un tendido que hace dos décadas permitió la exportación del combustible a Chile. Este proceso se realiza en coordinación con el Banco Itaú.

Fenosa cuenta con más de 1,6 millones de clientes en el Norte y también provee de luz a miles de hogares en San Juan, Jujuy y Tucumán. En el ámbito energético aseguran que Eurnekian impulsa la venta de estos activos para, fondos frescos mediante, intensificar su apuesta por la producción de gas, sobre todo en la cuenca Austral.

En definitiva, el ámbito energético aparece como uno de los segmentos que mayor expansión viene exhibiendo desde que Cambiemos define el rumbo económico del país. La decisión del macrismo de profundizar la generación nuclear deja en claro que la política dista de ser momentánea.


Y para el empresariado nacional semejante apuesta representa la certeza de que es un buen momento para volver a hacer negocios de envergadura en la Argentina.

          What Might Have Been - Columbus Blue Jackets Jersey Concept   

Reader Nathan submits our latest feature, and it's a doozy! It's a Pro Player jersey concept for the Columbus Blue Jackets from around 1998 or 1999. The final jersey design was announced on October 15, 1999 so I would say this predates that announcement by at least several months.  Prototype jerseys are exceedingly rare, and eagle eyed collectors are happy to obtain them when the opportunity arises.


Many of the elements made it into the final version of the team's jersey, others introduced years later and some may never be used, but are often part of the discussion.  Pro Player replicas were some of the best jerseys made at the time and it's a shame they went out of business before the start of the 2000-01 season. The tag on this example shows the version as 10B2.



The first, most noticeable difference from the final Columbus jersey design is the use of chevrons on the sleeves. These symbols are synonymous with military and in line with the heritage of the Blue Jackets the team name is based upon. These have been seen in design drawings for subsequent Columbus jersey designs, but they've yet to make the cut. One of the problems that keeps this from being used is the requirement for numbers on the arms of all NHL jerseys. While it looks nice enough in these photos on a blank jersey, if you add the numbers, the design becomes cluttered and less pleasing. 



The use of a tie down on the front of the jersey would eventually become an element in the first Columbus alternate jersey in 2003 as well as the current alternate introduced in 2010. At the time, it would have made Columbus the second team in the league to utilize this now common (and overused) design.

Another interesting difference is the angled, sewn star pattern on the cuffs of the sleeves. The eventual design would use four stars instead of five in a straight pattern and they would be sublimated into the fabric and not sewn.

The blues on the entire jersey are a lighter shade than the final design. The stinger patch and crest both use a lighter base shade than the final version and the jersey itself incorporates a very light blue as it's primary accent color with darker blue trim and grey in the collar. A similar light blue, darker blue and gray pattern is used in the current alternate jersey.

Die US-Börsen haben am Dienstag kurz nach Handelsbeginn ein leichtes Minus verbucht. Gegen 16.15 Uhr verlor der Dow Jones Industrial Index um 8,67 Einheiten oder 0,04 Prozent auf 21.400,88 Zähler. Der S&P-500 Index fiel 3,52 Punkte oder 0,14 Prozent auf 2.435,55 Zähler. Der Nasdaq Composite Index verlor 26,16 Punkte oder 0,42 Prozent auf 6.220,99 Einheiten.

Im Fokus der Anleger stand die Rede des Präsidenten der Europäischen Zentralbank (EZB). Der Konjunkturaufschwung im Währungsraum gewinnt aus seiner Sicht immer mehr an Kraft. Daraufhin hatten Staatsanleihen in den USA wie in Europa bereits deutlich schwächer notiert.

In den USA wurden kurz nach Handelsbeginn Daten zum Verbrauchervertrauen und zu den US-Hauspreisen publiziert. Der Indexwert zum Verbrauchervertrauen für Juni fällt mit 118,9 Punkten besser aus als erwartet. Im Vormonat war er noch bei 117,6 gelegen. Die Preise am US-Häusermarkt sind im April, gemessen am Case-Shiller-Index, allerdings etwas schwächer gestiegen als erwartet. Im Vergleich zum Vorjahr legten die Preise in den zwanzig größten Ballungsgebieten um 5,67 Prozent zu. Im weiteren Tagesverlauf wird sich darüber hinaus die Chefin der Notenbank Fed, Janet Yellen zu Wort melden.

An der Wall Street haben sich Banken und Energieunternehmen an die Spitze der Gewinner katapultiert. Chevron notierte mit einem Plus von 0,44 Prozent. Ölschwergewicht Exxon konnte im frühen Handel ein kleines Plus von 0,17 verbuchen. Ähnlich wie in Europa konnten am heutigen Handelstag Bankentitel zulegen. JP Morgan Chase notierten mit einem Preisaufschlag von 0,53 Prozent. Anteile der US-Großbank Goldman Sachs stiegen um 0,61 Prozent. Auch die Titel der Citigroup verteuerten sich. Sie stiegen um 0,69 Prozent.

Die Titel der Google-Mutter Alphabet verloren 1,04 Prozent im frühen Handel angesichts einer Rekordstrafe in der EU. Auch andere Hochtechnologieunternehmen notierten heute tiefer: Apple verloren um 0,29 Prozent. Facebook-Aktien verbilligten sich ebenfalls um 0,91 Prozent.

Anteile des US-Telekomanbieters Sprint konnten um 5,74 Prozent zulegen. Sprint ist derzeit mit den US-Kabelanbietern Charter Communications und Comcast im Gespräch über eine engere Zusammenarbeit.

Aktien von Autobauer General Motors notierten wie erwartet etwas tiefer. Sie verzeichneten ein Minus von 0,49 Prozent. Das Unternehmen aus Detroit hatte zuvor sein Absatzziel gesenkt

CATATAN YANG BELUM RAMPUNG DARI DR.M.RAKIB JAMARI PEKANBARU RIAU INDONESIA.
Akidah tajsim dan tasybih hingga pada suatu keyakinan bahwa Allah seperti sosok seorang pemuda , berambut ikal , bergelombang dan mengenakan baju berwarna merah. Klaim ini dikatakan oleh Ibnu Abu Ya’la dalam kitab Thabaqat al-Hanabilah. Abu Ya’la mendasarkan pernyataan itu kepada hadits berikut :
عن عكرمة اَن الرسول صلى الله عليه وسلّم قال: راَيت ربي عزّ وجلّ شَابا امرد جعد قطط عليه حلة حمراء
Dari Ikrimah: bahwa Rasulullah SAW bersabda, “Aku telah melihat Tuhanku SWT berupa seorang pemuda berambut ikal bergelombang mengenakan pakaian merah.” (Ibnu Abu Ya’la: Thabaqat al-Hanabilah, jilid 2, halaman 39)
Riwayat-riwayat palsu produk pikiran Yahudi itu kini berhasil membodohi akal pikiran , sehingga mereka menerima keyakinan seperti itu. Tidak diragukan lagi, hadits semacam ini adalah kisah-kisah Israiliyat yang bersumber dari orang-orang Bani Israil.
Ada yang bercerita tentang Allah duduk di atas kursi emas, beralaskan permadani yang juga terbuat dari emas, dalam sebuah taman hijau. Singgasana (Arsy) Allah dipikul oleh empat malaikat dalam rupa yang berbeda-beda, yaitu seorang lelaki, singa, banteng dan burung elang. Keyakinan aneh semacam ini dipaparkan oleh Ibnu Khuzaimah dalam Kitab at-Tauhid wa Itsbat Shifat ar-Rab.
Siapakah Ibnu Khuzaimah? Dia adalah salah seorang ulama ahli hadits yang dijadikan referensi. Namun setelah semakin matang dalam pengembaraan intelektualnya, Ibnu Khuzaimah menyesali diri telah menulis kitab tersebut, seperti dikisahkan oleh al-Hafidz al-Baihaqi dalam kitab al-Asma wa ash-Shifat hal. 267
Walaupun begitu, Ibnu Taimiyah tetap mengatakan bahwa Ibnu Khuzaimah adalah ”Imamnya Para Imam” karena menurutnya telah banyak meriwayatkan hadits-hadits ’shahih’ tetang hakikah Dzat Tuhan (padahal yang sebenarnya hadits-hadits itu kenal dengan nuansa tasybih dan hikayat Israiliyat). Oleh karena itu, ketika mengomentari sebuah hadits yang diriwayatkan Ibnu Khuzaimah, Ibnu Taimiyah berkata :
”Hadits ini telah diriwayatkah oleh ’Imamnya Para Imam’ yaitu Ibnu Khuzaimah dalam Kitab at-Tauhid yang telah ia syaratkan untuk tidak berhujjah di dalamnya melainkan dengan hadits-hadits yang dinukil oleh perawi adil dari perawi adil lainnya, sehingga bersambung kepada Nabi SAW” (Ibnu Taimiyah: Majmu Fatawa Ibnu Taimiyah, Jilid 3, hal. 192)

          Year End Thank You Cards for Teachers   

Hello my friends!

Today I have a bunch of  Year End Thank You Cards for the Teachers to share with you all. Both my kids go to Portuguese School so that is why I made so many! I always like to thank the teachers with a little year end treat, as I could never do what they do and have so much appreciation for them.

I pulled out most of my Teacher stamps and zoned out creating them. I chose not to film the process video as this would be way too long to watch! I mixed and matched the stamps I had from various companies to make some one of kind cards.

Here is my first card.




For this card I used the Thanks A Bushel set from Lawn Fawn and a retired set from Clearly Besotted Best Teacher. I love that little happy apple face 😊

I colored this one in using my Zig Clean Color Brush Markers. and just added some glossy accents to the happy apple!




On the inside I also used stamps from the Best Teacher set.
This really cute and simple card was made using the apple from the Thanks A Bushel set plus the sentiments from SSS Hey Teacher.






This time I used my brand new Tombow Dual Brush Markers to color the apples in!

And again added glossy accents only to the glasses on the apple.






I had fun with this ruler card.
Here again I used my Tombow Markers in rainbow order colors and blended the colors out with a clear Spectrum Noir Sparkle pen.








I also added glossy accents to the die cut heart just to make it pop!
For this last card, I used the Apples from the Thanks A Bushel set and spaced them out using my stamp positioning tool.




Really simple and sweet!
All my cards actually came together very quickly. I guess that's what happens when you limit the stamps sets you use or have 😏

          Funny Food Cards For Dad   

You all ready for Father's Day?
I know I'm not, but at least I have my cards ready!

Today's cards feature Simon Say Stamp Funny Food stamp set. I think these cute food images and punny sentiments worked perfectly to create a Father's Day Card. They would also be perfect for a Birthday or Valentine's Day card! 


While I was making these cards, I realized I had only ONE Father's Day stamp... how can that be!?!
 I will have to rectify that problem soon, or at least before next year 😏

Pretty sure if you have a child at home or know any kids you have
Well, both my kids and all their friends seem to be obsessed with this latest craze. So I thought it would be "cool" to create a paper spinner that I could use on a card that they and their friends would love.

          Mermazing Circle Spinner Card   

Hello friends!

Today I have a really fun card to share with you all featuring MFT's Mermazing stamp set. I can't believe it's taken me so long to make something with this set. I LOVE, LOVE, Love it! I'm sure you may see a few more cards created with this set in the near future.

It's hard to tell from the picture, but the fish and turtles spin all around the card. There is an acetate ring that allows the critters to move all around the mermaid. 

I just love making interactive cards like this and usually the recipients love them too 😉


I guess you could call this a mixed media card as I used so many coloring elements.
Kuratake Gansai Tambi Watercolor, Distress Oxide inks, and Prismacolor colored pencils... oh, and a million other supplies, lol! You will see that in the links below.😲

          Vellum Embossed Birthday Cards Featuring Studio Katia's Mandala Flower    

Hello my friends!

It's been a few weeks since my last post. Haven't had enough time to play recently... felt like I was going through a craft withdrawal, so I had to get my fix!

Today I have a few cards to share with you that feature Studio Katia's Mandala Stamp that I recently purchased. In my house I feel like I never have enough Birthday Cards especially for adults... so that's what I was going for. I think these could of easily have been made into Wedding Cards as well.

Love the simplicity and elegance to them. 


I paired them with the Sending and Wishing dies from SSS and well as the You Matter stamp set.


Not sure which one I like the most 😍


On the inside of the cards I stamped them both with the Happy Birthday sentiment from the SSS Big Scripty Greetings set.

          Studio Katia Flower Cards   

Hello friends!
 Hope you are all well... I've been battling a cold for about a week now but it hasn't stopped me from playing with my new stamps 😆 cough, cough, sniffle!

Anyways, recently Studio Katia celebrated their 1st Birthday Sale to which of course I had to take advantage of. I was able to pick up a few stamps sets and a bunch of sequins before stuff sold out! Cool part is Studio Katia is local and from right here in my city. What a small world!!!

My cards today feature her Thank You So Much stamp set. 
I just love how big this Flower bloom is!

          SSS Sketch Ranunculus Bouquets for Mom Cards   
Hello there everyone!

Wishing you an early Happy Mother's Day to all my Mommy friends out there. Hope your weekend will be filled with lots of hugs and kisses from your loved ones!

Today I want to share with you the cards I made for my Mom and my MIL. 
Since I love flowers I figured my mom's would too! I used the SSS Sketch Ranunculus Stamp Set to create the bouquets.


For my coloring, I used the Zig Clean Color Brush markers
I love how easy these markers are to work with and blend!


The other stamp set I used for my cards comes from Mama Elephants - Labelled Messages.


I filmed a process video for these cards if you wanted to take a look on how they came together.

          FREE - Forty Birthday Cake Topper SVG and Studio File   

Hello and welcome back friends!

Last week I shared with you all a card I made for one of my best friends who recently turned 40. Well today I want to share not only the cake I made for her but I also want to give you the file for the cake topper I created in her honour... for FREE of course!

With limited time, I thought making a naked cake for her celebration would be the quickest and easiest... well I was kind of right. It was way quicker than making a fondant covered cake but not the easiest, as I had never done this before. I am truly and happy with the results and love the look of the fresh flowers, which was a first for me too!

The cake itself was half vanilla and half chocolate. 
Bottom layers chocolate, top vanilla.
I used 10 inch pans for bottom tier and 6 inch for the top tier.
The entire cake was covered with vanilla buttercream icing and finished it with a caramel syrup.

Doesn't it look Yummy!? 😋


As for the cake topper...

I designed the topper using the Silhouette Studio Software.
I cut out 3 layers of heavy 110 lbs white cardstock. 
Glued them back to back with a spray adhesive.
Cut out my glitter layer and adhered that one to the top. 
(I didn't have any gold glitter paper left, so I improvised and used a piece of Cricut Glitter Vinyl in gand adhered it to a piece of 60 lb cardstock and then cut it out... worked like a charm!)
I then used hot glue to secure a very thin wooden dowel to the back of the topper,
and that's it... fancy DIY topper all done!

          Triple-Layer Cake Box Cards   

Hello friends! How are you? 
Seems like it's been a little while since my last post. Life just seems to get busier and busier everyday!

I hadn't realized how long it had been since I had used my Silhouette to create some 3D papercrafts (my first love). So today I want to share with you a few box cards from SVGCuts Garden Party Box Cards SVG Kit that made for some very special ladies in my life.

I decided to make the same triple layer cake box card for both of them since they were for birthdays. Plus, it was just quicker to do them both at the same time when most of the same supplies were being used. I did alter the file by increasing the size by approximately 25%.

My oldest friend on this planet, well more like sister, turned the big 40 this past Tuesday 💗
I thought this triple layer cake card was perfect for the occasion!


As you can see I added the numbers to the top of the cake. To make them, I used the SSS Big Number dies set and just cut the numbers out of metallic paper using my Big Shot. The rest of the card was cut out using my Silhouette Cameo. To finish the back of the card I used a stamp from MFT's Magical Unicorn stamp set. 


These cards always amaze me. 
I just love how they fold flat and fit nicely in an envelope!


Here are both the cards I made side by side. 
The card with 80 on top,  I made for my Grandmother who is celebrating her 80th birthday in a few weeks. Unfortunately, I won't be with her that day because she lives in Portugal, but my mother will be hand delivering it to her for me!


Since I went with silver for the previous card, I chose to do this one in gold. 
To the centres of the flowers I added some tiny drops using the Dandelion Nuvo Crystal drops
To add some interest to the flower petals, I inked up all their edges with a coordinating distress ink pad. Check the links below for more details. 



Of course I didn't have any Portuguese stamps to stamp on the back of the card so thankfully I had the Perfectly Penned stamp set from Concord and 9th to save the day!
Translated it means "80 Congratulations Grandma"

          Hidden Inlaid Die Cut/Camouflage Technique - Dahlias for Zulmira    

Hello my friends!

Today I have a beautiful birthday card to share with you featuring Wplus9's Beautiful Bouquet Dahlia and MFT's Little Letters Die-namics. This birthday card was made for a very special family friend. As you can see from the card, her name is Zulmira. I personally know what is it like to have such a unique name, and finding anything personalized is impossible unless it is custom made. When I receive anything with my name, it feels extra special because it's so uncommon. So that feeling is exactly what I had in mind when I created this. 


I had never done an inlaid die cut or camouflage technique before, but I am so happy with how it turned out. I'm pretty sure I will be doing more in the future! I really love how the letters pop off the card without taking away from the beautiful stamped design.


Here is how I finished the inside.
Love this scripty stamped birthday sentiment from Clearly Besotted.


I called on my inner Kathy Racoosin when I was coloring this, but I am no expert and about half way through I thought it I thought it was going to be scrapped! Luckily I kept going and love the end results 😍 I have learned that watercoloring takes patience and lots of layers...so just be patient!

For my first card I created a hidden slider card from the new Rain or Shine Stamp set.
I loved building this little scene... for some reason this little girl makes me think of my Mother as a young girl walking along the flower fields in Portugal. 


Depending on where the little Girl is positioned you will see a different sentiment.

I think this Pansies Stamp set is perfect for making  Mother's Day Cards.

For this card I did some no line water coloring using Jane Davenport's Petite Palettes.  
Sweet and simple.

Hello Everyone!
Sorry it's been a little while since my last post...
we decided to take a last minute trip for Spring Break to Mexico and am just getting back into the craft room today😎

So before we left for our trip... ironically, even before I knew we were going anywhere I had made these fun Under the Sea Shaker Cards featuring the Little Mermaids from The Greeting Farm. I must of had the ocean on my mind, LOL!

Love how they turned out 😍


If you look close enough, you can see the mermaids are also suspended by a string allowing them to flow freely inside the card... got inspired by one of Jennifer McGuire's recent videos.


Here is my second card, same idea in a vertical layout.
I used the sentiment from the Greeting Farm's Magical Day Stamp set for this card. Not listed in the links below.

          Thinking Of You Posies Bouquet    

Hello Everyone!

Who doesn't like to receive flowers? How about a gorgeous posies Bouquet? Flowers don't always have to be the real ones you know 😉 I know I would love to receive some 💗🎕

Today my card features FB Stamps Posies Stamp set that SOLD out really fast when they were just released. Well the good new is that they are now back in stock again! YAY!


Take a closer look at these pretties. I just love how this card came together!

All I did was a little bit of masking on the base layer of the card and then just cut out one of the flowers and popped it up with some foam in the center of the bouquet. Colored the images in with my Zigs and stamped the sentiment along the edge of the pitcher... and voila!
So pretty 😍

          You Friend Are Pretty Amazing - Encouragement Card   

Recently a very good friend of mine and long time work colleague completed her chemotherapy treatments and got the good news that we were all hoping for. Although she has lost all her hair, is very fatigued and is still in some pain she is determined to be her better self when she returns back to work with us. As an Oncology Nurse, unfortunately she now knows and can really relate to what it is like to be a cancer patient having experienced it all herself.  To celebrate her journey I made this card for her.

I mixed supplies from a few of my favorite companies to create this beautiful card. I stamped the background florals from SSS Blooming Day Set to using distress inks to create a water colored base.  Then added a vellum layer to the top to add my sentiments on the front of the card.           First Holy Communion Cake Topper + FREE Files

          First Holy Communion Box Card    

I'm always on the look out for cute religious card ideas and as soon as I saw SVG Cuts latest Easter Box Cards SVG Kit it I immediately had to get it!

This past weekend, we celebrate my youngest God Daughter's Communion Day and I thought this card would be perfect the occasion.

          When Pigs Fly Card - Flying Piggy featuring FBStamps   

It's true, it's true, pigs are flying!!!
Well at least in my latest card 😏


Not sure if you guys can tell, but check out the shiny little foiled pigs 🐷 in the the background (see next picture). I used Fleurette's coordinating "Three Little Pigs" Digital Foil It Paper Pack and the speech bubble is also a Foil It. Love how she has made these digi papers coordinate with the her Stamps. Just makes things a lot simpler when you are creating, takes out the guess work out of choosing papers! And using the "Foil Its" was fairly easy too, all you need is a laminator or a Minc, and if you don't have one of those... I've heard, an iron works too to transfer on the foil  😉

 How cute is this little flying pig?

          DIY Credit/Loyalty Card Duct Tape Wallet v3   

Hello my Crafty Friends!!!

I have a fun and very useful DIY project to share with you!
This post is a revision from one of my very first blog posts. 
Today I will be sharing with you version #3 of my DIY Credit/Loyalty Card Duct Tape Wallet.


Look familiar, well if you have been a follower since the beginning I'm sure you will recognize it. Still to this day, the original blog post - DIY "credit card" wallet is one of my most visited.

The purpose of this little guy is to hold all those loyalty/credit or business cards that normally end up taking room in your, probably overcrowded regular everyday wallet.

Since the last one I made for myself was falling apart, it was time I made a new one. So today I will share that how to video here with you all.

          Love It's Simple Card - Mermaid Marker Background   

Happy Monday!

I'm pretty sure most of you have heard of Jane Davenport by now. I have to say that since discovering her products at Michael's I have become a little... OK, maybe a  lot obsessed! I'm in love with her line and really, really want to get her watercolors but they are sold out everywhere... Hopefully they will be stocked soon!

The first product I bought was her mermaid markers, and OMG the color intensity is unreal! 
They are so vibrant and gorgeous. Check them out!


The back ground of this card was so simple to make. I had tried to record a process video to show you all how easy it was, but for some reason a part of it didn't record. For all the supplies I used check out the links below.

Basically all I did was flood my watercolor paper with clean water and them just touched the tips of the mermaid markers to the paper. I then gently squeezed the marker and dripped the color onto random areas and then watched the colors blend together. SO simple!

Here is a close up of these colors!


I don't know about you all but, I love the bright colors of the rainbow...  they make my heart happy!

So I'm finally getting in the mood for Valentine projects.

          Communicating Compassion   
Have you ever been so fed up with the poor customer service at an establishment that you left, even if it meant inconveniencing yourself by having to drive an extra mile or two to visit another location of the same company, or one of their competitors? I have, many times in the past, in fact. I am getting better about it lately, however – mostly, I believe, because I am attracting fewer unruly or unsatisfactory experiences, overall.

I had one occur yesterday, though – the first in quite some time. This was interesting, too, because although I did leave the store without making a purchase, it was not because the proprietor was rude to me. Rather, it had to do with the way he behaved toward other customers.

I won’t pretend this is an easy situation. In fact, having just posted a blog about judgment at Dangerous Tea Party, I am trying to figure out how to utilize this episode as a learning experience without sliding down that slippery slope into judgment.

The Details

As I walked into the FoodMart at a Chevron gas station, the proprietor was shouting angrily at a woman that she needed to “get off his property!” He yelled that he’d already told her to leave once, and she hadn’t left – now he needed her to leave IMMEDIATELY. In my effort to understand, I assessed the woman. She didn’t appear drunk. She had no shopping cart or even a bag with her. She wasn’t dirty or unkempt. Do I have any idea what preceded his angry outburst? No – because I wasn't there to see the precipitating incidient. Perhaps she had tried to steal something from the store. Maybe she’d had an altercation with someone in the shop. Fact is, this angry man might have had a very good reason for his obviously outraged reaction to this woman.


Until he resumed his position behind the counter, that is, to continue collecting payment from the line that had grown while he was outside throwing the woman off his property. He challenged a man in the line, “And you know I don’t want her here, but you bring her here anyway.”

The guy replied, “Hey, I’m just trying to pay for my drink.”

But Mr. Angry Chevron Proprietor was not done. He continued loudly, “No. I said, ‘Don’t bring her here,’ but you did. You brought her back on my property. You know – I want you out, too.” And he started screaming again. “You get out of here – get off my property, NOW!”

My Response

At which point I decided I didn’t need to buy gas or anything else at this particular gas station, so I took my money and went out those front doors, thinking to myself, “I will never do business here again.” But I’m not sure that’s the proper answer either. I find myself struggling with this idea of judging the proprietor – and that certainly is what I am doing, by deciding his behavior was so over-the-top, in my estimation, that I will never shop there again, particularly as I still don’t know what exactly led up to his banning the woman from his property.

I am not a shop owner, so I can only imagine what it must be like to deal with drunks, homeless, addicts, and panhandlers, particularly as they so often meander outside convenience stores and gas stations, accosting patrons and making people generally uncomfortable. These unsightly, unseemly people no doubt have a financial impact on business establishments, as well as influencing the caliber of clientele, and the shop-owners are fully within their right to protect their businesses and their customers.

an individual of his or her humanity.

I suppose what I’m hoping for, though, is a little bit of compassion. Having seen many a belligerent shop owner's response to a vagrant, my heart instinctively empathizes with the transient. Now, I am not denying that their choices led these individuals to the place where they are in their lives. They have volition, and responsibility for their decisions. But poor decision-making never robs an individual of his or her humanity. These shop owners have reached such a level of frustration, though, that they no longer can view the drunk, homeless, panhandling addict as a person; they see them only as a problem that needs correcting. And the obvious solution is to hurl them off the property as quickly as possible. I can’t help but think that for some, if erecting a moat or a wall with a sentry on duty wouldn’t adversely affect sales, they would jump right on it.

As I said before, there’s no easy answer here. I must keep in mind the Chevron guy’s desire to preserve a business he likely worked hard to build. But what I also wish is that he could keep in mind the effect his shouting has on both the individual he is confronting, and all the rest of us who must witness the confrontation.

On April 4, 2017, Citron Research ("Citron") published a report similarly accusing FleetCor of being a "predatory company by design, whose cores strategy is to methodically rip off its customers, using business practices and fees that are designed to deceive." On this news, FleetCor's share price fell $8.55, or 5.69%, to close at $141.60 on April 4, 2017.

On April 27, 2017, Citron published a follow-up report describing FleetCor's development of a scheme to categorize its partners based on the level of improper fees the Company could charge without the customers complaining. On this news, FleetCor's share price fell $5.73, or 3.79%, to close at $145.65 on April 27, 2017. On May 1, 2017, Chevron sued FleetCor for breach of contract. Following the filing of Chevron's complaint, FleetCor's share price fell $10.18, or 6.87%, to close at $138.00 on May 2, 2017.

On May 3, 2017, Citron reported on the Chevron lawsuit, stating that the lawsuit indicates that Chevron's termination of the FleetCor contract was due to the Company's mistreatment of its customers. On this news, FleetCor's share price fell $6.74, or 4.88%, to close at $131.26.

The Franco-American Museum at Château de Blérancourt reopens

After being closed for more than 10 years for renovation, following the discovery of archaeological remains, Château de Blérancourt is finally reopening its doors on Sunday 25 June 2017. It is an opportunity for the public to discover three new areas of this French museum dedicated to Franco-American friendship, each one highlighting the historical and cultural exchanges of an era.
 
Initiated in 2014 following a series of archaeological excavations, the renovation works, museum extension and display of the remains were financed by the French State with the support of American patrons – The American Friends of Blérancourt and the Florence Gould Foundation.

In light of the significance and quality of the work carried out, this museum is a point of reference for historical and cultural relations between France and the United States.

In 1917, Anne Morgan, daughter of the American banker JP Morgan, came to stay at Château de Blérancourt, near Noyon, to undertake the work of the American Committee for Devastated France (CARD), a humanitarian organisation that was set up to help the civilian population of Aisne, an area which had been badly affected by the devastation and by supply problems during the First World War. After the war, the organisation continued its work with a commitment to rebuilding the Picardy region from an economic, educational, social and moral point of view.
Supported from 1923 by "The French Friends of Blérancourt Museum", in 1924 the château became a museum for objects and works of art. Its collections are testament as much to French support for the American War of Independence as to American commitment to the French during the First World War.

In this museum, which has been recreated by Studio Adrien Gardère and Ateliers Yves Lion, visitors are invited on a tour of discovery in three sections – "Ideals", "Ordeals" and "Arts". Each will highlight the historical and cultural exchanges specific to different eras.
 
Films and audiovisual tools will explore the ordeals which have united the two countries (especially the two World Wars) and also the artistic exchanges between Paris and New York in the 20th century. As well as screens installed in each room, a multimedia guide on digital tablets will enrich the commentary and make the tour interactive.

Adaptation of the Vigipirate plan for the summer period

The security of French citizens and tourists visiting France continues to be the Government’s priority. The new Vigipirate stance will therefore be effective from 23 June to 4 September, to ensure the increased protection of tourist areas, public transport and crowded places.
 
The summer holidays will soon begin, with significant numbers of people travelling to their holiday destinations and large gatherings set to take place for sporting, cultural, religious and festive events. The Government has decided to adapt the Vigipirate stance accordingly.
 
The previous adaptation was agreed to ensure the smooth running of the presidential and legislative elections in the face of a heightened terrorist threat. The persistent threat requires that every measure be taken to ensure the public is protected during the sensitive summer holiday period. For this reason, the new Vigipirate stance "Summer 2017" will be effective from 23 June until the start of the school year on 4 September.
 
The need for a high level of vigilance requires the Vigipirate plan to remain in force at the level of "heightened security – risk of attack", which is the second of three levels contained in the plan.
 
Efforts are focused on the increased protection of:
  • tourist areas,
  • public transport,
  • crowded places.
The full mobilisation of internal security forces, supported by soldiers from Operation Sentinelle, will continue with any necessary redeployments to tourist areas. This mobilisation will also involve citizens through the use of National Guard reservists who will bolster the security arrangements that are in place.

A joint French-British action plan to ensure the internet cannot be used as a safe space for terrorists

On 13 June the President of the Republic received the British Prime Minister, Theresa May, along with the Ministre d’État, Minister of the Interior Gérard Collomb and his British counterpart, Home Secretary Amber Rudd. During this meeting France and the UK agreed to a joint action plan, placed under the responsibility of both countries' Ministers of the Interior, to ensure the internet cannot be used as a safe space for terrorists.
 
France and the UK will also coordinate with the countries of the European Union and G7; they are particularly calling for a meeting to be held shortly between the G7 Ministers of the Interior to widen support for this action plan.
 
Gérard Collomb is poised to host the key internet players at a forthcoming meeting, aimed at reviewing the progress that has been made and what challenges still lie ahead in the fight against online extremism.

European Defence: France hails the European Commission's plan

The Minister for the Armed Forces, Sylvie Goulard, welcomes the European Commission's presentation of a detailed plan on bolstering European defence.
 
Against the backdrop of recurring terror attacks, on European soil and worldwide, the European Commission's proposals are a reassuring sign that it recognises the need for action. It is the European Union and its members' duty to provide European citizens with greater protection.
 
Plans for a European Defence Fund, with the ultimate aim of distributing ambitious sums, have been outlined. This is a turning point for more effectively sharing costs and defence capabilities alike.
 
Thanks to this progress, the themes of innovation, means and technological sovereignty are gaining major political momentum – and must form the cornerstone of the common strategy. For Sylvie Goulard, this is an opportunity for seizing on the part of Europeans. An effective and constructive debate will have to be held within the European Parliament and Council so that these plans can come about as soon as possible.
 
The three different scenarios put forward by the European Commission are clear, and stake out the responsibilities we will each have to assume. France, which is devoting altogether exceptional efforts to the matter of defence, fully approves.
 
The Minister is poised to raise these subjects with several of her European partners and counterparts on 9 June in Prague, at the Defence and Security Conference organised by the Czech Government and the European Commission.

70th Cannes International Film Festival: Congratulations to the winners!

The Minister of Culture extended her warmest congratulations to all the winners at the 70th edition of the Cannes International Film Festival, whose Jury was chaired by Pedro Almodovar.
 
In particular, Françoise Nyssen congratulated Ruben Östlund, winner of the Palme d’Or for his film The Square. She extended her warmest congratulations to the French director Robin Campillo, who won the Grand Prix for his film 120 Battements par Minute, which puts audiences alongside the activists of the Act Up association in the midst of the devastating AIDS epidemic of the early 1990s. On 27 May, his film was also awarded the International Federation of Film Critics prize. Also in the spotlight were Sofia Coppola, who was awarded the Best Director prize for her film The Beguiled, and Andreï Zviaguintsev for Loveless, winner of the Jury Prize. French films rake in the awards

French cinema won a good many awards again this year in addition to the Grand Prix and Camera d’Or: the Critics’ Week Grand Prix went to Emmanuel Gras’ documentary Makala. The Directors’ Fortnight rewarded Léa Mysius and Paul Guilhaume’s screenplay for Ava. Claire Denis’ Un beau soleil intérieur and Philippe Garrel’s L'amant d'un jour won the SACD prize for the best French-speaking feature-length film. Mathieu Amalric’s Barbara was among the winners of the “Un Certain Regard” selection, obtaining the prize for Poetry in Film. And finally, the Oeil d’or, a prize awarded to the best documentary presented in all of the various selections, was awarded to Agnès Varda and JR’s Visages Villages.

Françoise Nyssen also applauded the festival’s President Pierre Lescure and its General Delegate Thierry Frémaux. Despite the recent attack on British youth in Manchester, they reacted appropriately and in a spirit of solidarity, while celebrating the Cannes International Film Festival’s 70th birthday.

Once again, France has demonstrated the part it plays in upholding and supporting a living, audacious and varied cinematic art.

This fabric called me as soon as I saw it.  It's part of my Austin fabric haul. It is a navy cotton background with bias strips of different prints. The stripes run along the width of the fabric, it looks like a chevron above but it's just the way I unfolded the fabric.

As the clock ticked down on my qualifying oral examinations, I was feeling optimistic that I was going to survive. But the last question I received was not one I had spent any time preparing for: “Why did you decide to study public law?” I had never examined it very closely. I stammered out a response that had the virtue of being close to truth: I had been energized by the constitutional revolution that was the Warren Court. The times they were a changin’. And I suppose that begs the question what would I do today if I read this book in graduate school?

Few disputes end up being resolved in formal court hearings in front of a jury. Over 90 percent of criminal cases are resolved through a plea bargain of some type. Civil disputes also typically get resolved outside a formal courtroom before the full trial process is engaged. It would be impossible for the judicial system to accommodate trials if the percentages were reversed, or even if half the disputes went to trial. But it is one thing for the parties to a dispute to make the choice to settle the case or enter into a plea bargain arrangement; it is something else for access to the courts to be curtailed or limited. In her comprehensive, but sobering book, Sarah Staszak examines judicial retrenchment and advances a conceptual framework for understanding the changes that have limited access to the court system for many Americans.

It is clear to anyone with a passing interest in the judiciary that the post-Warren Supreme Court has tightened standing requirements and made it more difficult to sustain class action suits. Staszak documents the clear decline in the number and percentage of class action suits, civil rights cases, and civil cases that reached trial in the federal courts. The numbers are staggering, suggesting the full impact of barriers to participation. It is also apparent that limiting access has unequal consequences. Groups and individuals that most need access are typically the ones who are most adversely affected. It is not surprising that access to the federal judiciary has gotten more difficult. But the reasons for the reduced access and their scope are eye-opening.

The author casts a light on the “judicial retrenchment” of court access, the “process by which a range of actors both exogenous and endogenous to the courts and Congress work to scale back access to the courts by targeting the institutional and procedural rules that govern political institutions” (p. 21). Casting light is an accurate assessment because much of what occurs, according to Staszak, is done at a “subterranean” level in the realm of procedural rules. The rules can and have been used to constrict access to the courts.

Staszak argues that attention to Court curbing, threats to jurisdiction, and “grand acts of politics” obscure the quiet and more important process of judicial retrenchment. There are many culprits across the political and institutional spectra that share in the process: “The goal of scaling back access to the courts comes from a multitude of actors both within and outside of the government” (p. 7). She argues that judicial retrenchment is as much—if not more—about Congress, bureaucrats, legal organizations, business, interest group politics, and judicial administrators acting with a variety of political and institutional goals in mind as it is about conservative judges on the nation’s courts. Staszak shows how partisans of all ideological stripes advanced procedures like Alternate Dispute Resolution (ADR) for different reasons and ultimately conservatives on the Court and in Congress were able to bend new and old rules to their advantage.

Those pursuing judicial retrenchment have employed a full range of strategies and tactics to limit access to the Court: standing, use of the Eleventh Amendment, CHEVRON rules for deference to agencies, limits on class actions, revised rules of discovery, pleading, and settlement, the wider use of arbitration, the [*87] expansion of qualified immunity for government officials, caps on attorney’s fees, and circumscribed jurisdiction for the courts.

One of the most striking revelations is the ultimate irony of judicial retrenchment. Change was often co-opted and turned on its head. What started out as a shield to protect workers and the disadvantaged was often transformed into a sword that was used against them. Groups pushed for changes like ADR to protect individuals from backlogged courts only to see general access to the courts curtailed and fewer safeguards left to protect the intended beneficiaries. The original intent of providing access for the politically disadvantaged has been undermined by the subterranean practices of sharply limiting entry to the courts and manipulating the institutional rules that govern judicial access.

Staszak establishes a strong theoretical context for the study, nesting her analysis in an American Political Development (APD) framework. She argues that the changes are a function of three factors: Insularity (the discretion over institutional rules and procedures), Ideology (defined broadly), and Temporality.

The author rejects the simple explanation that the cause is exclusively due to the fact that recent Supreme Courts have closed the doors to litigation or that the changes that helped create the conditions for judicial retrenchment were simply components of a decidedly partisan issue. She argues that the on-going retrenchment of the conservative courts is “only a very recent phase of a much longer and more complicated institutional story” (p. 211).

The process of judicial retrenchment occurred across four distinct (but ultimately related) domains. In four case studies, Staszak carefully and painstakingly traces the evolution of rules and institutions that created judicial retrenchment and what Marc Galanter (2004) called “the vanishing trial.” She is able to trace the current judicial retrenchment to reform efforts that began as much as a century earlier. To limit access to the formal mechanisms of justice, institutional and external actors have attempted to: change the decision makers (focusing on ADR and the Administrative Procedures Act (APA)), change the rules of the game (focusing on the Federal Rules of Civil Procedure (FRCP)), change the venue (focusing on moving things to less formal procedures such as arbitration or mediation) and change the incentives (focusing on removing support like attorneys’ fees to make it more difficult for some aggrieved to find and get legal assistance). Using the best institutional history traditions of APD, Professor Staszak connects the dots.

While there are significant differences between the processes described in the four case studies, there are some consistent underlying patterns. In almost every case, the process began innocently enough as some “good government” motivated reform. The design was usually to help the very people and groups who would later be adversely affected by retrenchment. The initial motivations were often tied to concerns with the judicial system, but they seldom emerged from or were created by standard partisan divides. Proponents of the change focused on procedures and often did not appreciate the substantive implications of the changes they helped launch.

Changing the decision makers from judges and the venue from the courts to administrative agencies were intricately tied to the growth of the administrative state. Newly created agencies were empowered with quasi-judicial as well as quasi-legislative power. Proponents of the evolving administrative state, led by President Franklin Roosevelt, valued expediency and saving resources, but also sought to circumvent the courts and the legal profession that they considered to be a drag on their initiatives and the defenders of a failed status quo. Presidents have tried to protect the province of the administrative agencies and occasionally that meant supporting initiatives that might limit the reach of the courts.

The birth of ADR was tied to a desire to help the average individual and employees. Courts were crowded, litigation was costly, and the adversarial system engendered unnecessary conflict. Ultimately business and corporate interests were able to use ADR to serve their purposes. But in the long run, the growth of ADR became another barrier to use of the courts: a change in the locus of decision making from trained judges. The bar, lawyers, and judges fought this “Judicialization of Administrative Procedure” with mixed success.

The change of venue case study also concentrated on the APA. Calls for revisions have been [*88] vocalized over the last seven decades and alliances have shifted, but the APA itself has undergone few large scale legislative changes. That does not mean that presidents and Court interpretations of the act have not wrought significant changes over time. Indeed, few of the critical statutes and landmark precedents that were foundations of the rights movement have been overturned, but procedural changes have had a major impact on access to the courts.

The change of the rules started innocently enough, once again to assist those who would be more adversely affected by the delay and prohibitive cost of formal judicial proceedings. While this was similar to the process of growing ADR, the change in the rules (primarily the FRCP) divided lawyers and judges and represented a different dynamic.

The major incentives concentrated on attorneys’ fees. The ability to assess fees played a very important role in helping to create a foundation for civil rights actions. The Court also issued a major landmark in MONROE V. PAPE (1961), a decision that revived the use of section 1983 of a Reconstruction period Civil Rights Act to allow individuals to sue governmental officials. These initiatives helped generate a significant growth in law suits. But they also triggered a series of responses. Republicans in Congress pursued a strategy to limit civil rights suits while encouraging big business to use these vehicles to sue the federal government. And the Supreme Court took up retrenchment by sharply limiting the scope of section 1983 suits and attorney fees, often in the face of Congressional support particularly for the latter.

Any critiques of this book would be small quibbles. The detailed narratives in each of the four substantive chapters are valuable. But they come at a bit of a cost. The reader may lose the forest periodically for the trees. The author has an elaborate theoretical framework, but it occasionally gets lost in the details. But let me underline that these are relatively minor concerns.

So what would I do today if I was a beginning graduate student looking for a research area? The Rehnquist or Roberts Court would not have provided the same catalyst. Studying Congress would be out. Who would study an institution with a less than ten percent favorability rating? And as for studying the Presidency? Well there is always Comparative or International Relations or Political Theory.

          Rex Tillerson Has Been Misleading the Public About the Dangers of Fracking for Years (Video)   
In a 2013 interview, Tillerson made the false claim that there had "never been a verifiable case of fracking polluting drinking water."

Louis Meeks’ well drew crystal clear water for thirty-five years. His water was so clean neighbors often came by to take a jug home. Then, in 2005, his water turned cloudy. Petroleum on the surface reflected rainbows and it smelled like a gas station.

On New Year’s Day 2009, Norma Fiornento’s water well exploded, blowing a concrete slab off the top of the well.

In the summer of 2010, Steve Lipsky found out by chance his water well was so polluted he could light the gas in his water on fire. When lit, the flame rose four feet above the well's vent.

When the shale gas boom hit, oil industry CEOs and their PR teams across the country had good reason to keep these cases quiet. New horizontal drilling technologies, combined with upgraded hydraulic fracturing technique, were about to unleash an American fossil fuel energy “renaissance.” Evidence that this new technology polluted drinking water would have enormously complicated their plans to sell “fracking” as a clean, climate-friendly answer to America’s energy needs.  

The oil industry quickly grasped that water pollution was a threat to the branding of their new technology. Industry lawyers and PR people developed a series of talking points and legal strategies to belittle or silence those who spoke out about the rapidly multiplying cases of water pollution associated with fracking.

Some victims were simply bought off in exchange for silence agreements that prevented them from talking publicly about their cases. Even independent scientists trying to figure out how many wells were being polluted couldn’t get access the data from these sites.

Other victims presented more of a problem. Industry scientists testified in court that there had always been gas in the water. People who pointed out that their water had been fine for decades and then turned bad after fracking started were portrayed as gold-diggers looking to fleece beleaguered oil companies struggling to supply the country’s energy needs. It worked. With help from sympathetic (and largely conservative) media outlets and a barrage of propaganda from industry front groups like “Energy in Depth,” the industry was able to brand the victims as liars and charlatans. “Their water was always like that” became a meme—a “sciencey” explanation that let the industry off the hook and blamed the victims. Each new case got the same treatment, and with oil industry PR money behind it, much of the nation believed it.  

Central to the oil industry’s branding of fracking as a clean source of energy is the claim that “there’s never been one case of water pollution from fracking.” Rex Tillerson, CEO of Exon (and now Secretary of State) looked straight into the camera and proclaimed in an interview with Charlie Rose in 2013 that after “a million data points,” there had “never been a verifiable case of fracking polluting drinking water.”  The claim was patently false. At that point we knew aquifers had been polluted in Dimock Pa, Pavilion Wyoming and Parker Country Texas.  Texas, Colorado, Wyoming resulting in dozens of water wells being polluted. Testing in all three cases pointed to gas extraction.

In fact, there are documented cases of fracking contaminating drinking water as early as the 1980s. An EPA report from 1987 showed that “fracturing the Kaiser gas well on Mr. James Parson’s property, fractures were created allowing migration of fracture fluid from the gas well to Mr. Parson’s water well.” Industry itself admitted that fracking polluted the well.  During the 1990s when modern fracking technologies were being pioneered in Texas, widespread instances of pollution were acknowledged by Texas regulators.

But with enough people in positions of power and influence repeating it, the claim that there had never been a single case of fracking polluting drinking water became a “fact.” Media figures, oil industry officials, politicians, state regulators and gas and oil PR teams repeated the same story line: Fracking has been around for seventy years and there’s never been one documented case of pollution.

There were numerous problems with this story. First, modern slick-water fracking combined with horizontal drilling is a relatively new technology.  Comparing the “stimulation” of old vertical wells to modern fracks with pressures up to 15,000 PSI and hundreds of chemicals is like comparing a 1960s rotary phone to today's iPhone.  

Also left out of the not-one-case story is a clever sleight of hand with the definition of fracking. The oil industry defines “fracking” as only what happens in the horizontal section of pipe thousands of feet underground. According to this reasoning, the only way fracking can pollute drinking water is by migrating through thousands of feet of solid rock. Pollution from the vertical part of the well—where most leaks occur—or surface activity is not in this technical definition pollution from fracking.

Of course, most people understand fracking as the whole process of transporting equipment and chemicals to the site, drilling the well, extracting the gas and transporting it to market. Oil industry PR people are perfectly willing to use this confusion to their advantage. They can cite scientific papers claiming that “there has never been a case of fracking polluting drinking water,” and let the public believe they are referring to the common-sense definition of fracking as the entire industrial process.

Industry leaders like Tillerson know all this, of course. But they just keep repeating the same misleading claim. If enough “experts,” authority figures and media personalities keep repeating it, the big lie becomes a fact in people’s minds. And once it’s embedded, these everyone-knows-it facts are very difficult to dislodge.

An important part of the oil industry drive to control perceptions of fracking is demonizing its critics. Victims are portrayed as greedy fraudsters. Environmentalists are portrayed as hysterical, hypocritical busy bodies inventing scandals about a clean energy technology they should be celebrating. Filmmakers like Josh Fox, whose film “Gasland” shined a spotlight on cases of pollution associated with fracking, were subjected to withering character assassination campaigns.

The IPAA, the oldest petroleum industry association in the nation, funded a film a film to discredit “Gasland” called “Truthland.” It was a shiny spin piece that painted any case of water contamination as naturally occurring. The best known of these fracking-denial films is “FrackNation” by Phelim McAleer. McAleer has made a career out of making films depicting environments as hypocritical elitists and pollution victims as frauds and liars. A darling of conservative news outlets, McAleer has been one of the most effective proponents of fracking-has-never-contaminated-drinking-water meme. Other media figures like Alex Epstein and Ezra Levant have cashed in by writing Ann Coulter-style books popularizing oil industry talking points. Levant is famous in Canada for his shouting-head attacks on oil industry critics.

IPAA also fired up their own PR “news” outlet, Energy In Depth. In a memo announcing the new media group, IPAA stated the group’s goal; “EnergyInDepth.org: a state of the art online resource center to combat new environmental regulations,”. The venture was funded by major gas and oil interests including; BP, Anadarko, Marathon, EnCana, Chevron, Talisman, Shell, Halliburton and Schlumberger and Energy in Depth remains one of the main purveyors of the gas industry’s talking points regarding water, fracking and pollution.

When a reporter or member of the public asks if fracking pollutes drinking water, they’re likely asking if any part of the entire process contaminates drinking water. That’s logical since the entire process will be used as the nation moves forward with the planned fracked gas revolution. When the question is answered with a resounding, seemingly convincing ‘NO’, the reporter or citizen thinks no water has ever been contaminated by any part of the fracking process.

While industry has gotten away with this ruse for a decade, hundreds of cases of water contamination have become known. After a long fight, The Scranton Times got Pennsylvania’s Department of Environmental Protection to count the number of letters it sent to residents confirming incidence of water contamination during their fracked gas boom. That number was 243. The Associated Press found at least four states had recorded water contamination also. One troubling fact keeps us from knowing how many cases have actually occurred. When a homeowner settles their case with the operator, they are required to sign a silence agreement that disallows them from sharing any facts about their case. Not only do we know hundreds of cases of water contamination related to the fracking boom have occurred, as it is today, we can never know how many cases there really have been.

I cut some Seasonal Layer Thinlit leaves and used one of the greetings from the matching stamp set Colourful Seasons to make the gift tag. A little useful gift anyone would love to receive.

          Nautical Craftiness Take 2   
I have been at it again creating for our new nautical theme at school.  I'm in love with these creations.  Not spending a lot and getting such cuteness for my money Room 6 is going to have some nautical cuteness this year.  Take a look below.

I bought this anchor from Hobby Lobby.  It was brown with  a natural color rope.  I painted the anchor white, and then went back and taped it off with painter's tape and put the chevron pink stripes on.  I then painted the rope green and covered it all with modge podge to seal it up.  

I found this light house light in a shop here in town.  The white was yellow, and of course  red is not in my room.  So now the lighthouse is rocking pink, green and bright blue.  

This little creation I am so proud of.  I bought the candle stick in one of our 2nd hand stores here in town for $2.00.  I brought it home and gave it a nautical paint job.   I then attached a styrofoam ball to the top and added the candy.  My tree last year was loved by all and was used for positive behavior. When a student goes up on the behavior chart, they can get a sucker off the tree. I think this tree will be a hit.  Much bigger, so Mrs. Lisa and Ms. Kelly will not have to fill it up as often.

          Empire’s Deal With Circle K Is Its Biggest Acquisition Ever   

DALLAS -- Empire Petroleum Partners LLC’s asset purchase agreement with Alimentation Couche-Tard Inc.’s Circle K Stores Inc. and CST Brands Inc. to acquire 70 Corner Store gas stations “represents the largest acquisition in the company’s history,” said Nandit Gandhi, chairman of Empire’s board of managers. It also allows the fuels wholesale distributor to enter a new state, Arizona.

Following a review by the Federal Trade Commission (FTC), Couche-Tard agreed earlier this week to sell a portfolio of 71 properties to Empire to satisfy compliance with regulatory requirements associated with its own acquisition of CST Brands Inc.

As reported in a CSP Daily News Flash, to facilitate Empire’s purchase of the convenience stores from Couche-Tard, Getty Realty Corp. has entered into an agreement providing acquisition leaseback funding to Empire, which will acquire fee-simple interests in 49 c-store and gas-station properties for $123 million under a unitary lease.

The acquisition of these Corner Store locations will expand Empire’s geographic reach, adding to its presence in six states where the company has existing operations, including Colorado, Florida, Georgia, Louisiana, New Mexico and Texas, as well as new entrance into Arizona.

“Empire’s team partnered with Circle K to complete an expeditious and effective process to solidify this compelling deal with numerous strategic benefits. The transaction also signals a considerable stride forward as Empire successfully executes on its acquisition goals, delivering meaningful U.S. expansion, along with increased scale and synergies, to significantly enhance our competitive position as a leading U.S. motor fuels distributor,” Gandhi said.

“As consolidation continues in the motor-fuel and convenience-store industry, we remain focused on driving Empire’s rapid growth trajectory to become one of the largest and most formidable wholesale motor fuel distributors in the U.S. [This] asset acquisition represents a significant step on that path and is expected to greatly add to the financial strength of the company,” he said. “Looking ahead, we intend to continue to make strategic acquisitions as a part of our strategy to drive consistent, profitable growth and position Empire for even greater success in the future.”

The companies said they expect to complete the transaction, subject to customary closing conditions and regulatory approval, this summer.

Laval, Quebec-based Couche-Tard's network includes 8,081 convenience stores throughout North America, including 6,710 stores selling motor fuel, mostly under the Circle K, Kangaroo Express, Mac's and Couche-Tard banners. Its North American network consists of 15 business units, including 11 in the United States covering 41 states and four in Canada covering all 10 provinces.

CST Brands, San Antonio, has more than 2,000 locations throughout the southwestern United States, Georgia, Florida, New York and Eastern Canada.

Dallas-based Empire distributes motor-fuel brands, including Shell, Chevron, Texaco, Valero, Sunoco, BP, ExxonMobil, CITGO, Marathon, Gulf and Phillips 66. It distributes more than 1.1 billion gallons of motor-fuel products to more than 1,500 gas stations in 29 states and the District of Columbia.

          Day #8 Twelve Days of Christmas | DIY Gift and Tag   
Hello everyone! Stopping in for a quick breather from Christmas Cheer making and everyday living to share a relatively quick and easy DIY gift and tag with all of you. This item would make a fun gift for a neighbor, co-worker, teacher, etc.

I purchased the jar below at Wal-Mart and filled it with the dry ingredients of a favorite gingerbread type recipe that I love to make around this time of year. (Mr. Food's Nice Spice Cookies). On the "baking with love" card I typed up the other (wet) ingredients needed to complete the recipe as well as the recipe itself. A little stitching here and there and the addition of that adorable cork gingerbread man over the printed image on the card/tag adds a little extra special touch! The chevron green circle (top of jar) was a scrap left over from the snowman card I posted here on the Chic Tags' blog (Day#1). Also, I  raised the adorable little gingerbread girl with some foam adhesive for added dimension to the top of the lid decor. The baker's twine was stitched through the openings in the doily with a large eye needle and tied off into a bow.



Materials needed:
 medium sized glass hinged jar
dry ingredients to add into jar
2 1/4 inch red cardstock (punched/use a circle cutter)
foam adhesive
roller adhesive
baker's twine ~8 inches
favorite coordinating ribbon ~8-10 inches
~ 3 inch doily (on hand) 
2 inch patterned paper (I used scrap from my Christmas Cheer kit - green chevron 3x4 card)

          Chic Tags Twelve Days of Christmas | Day #1   
Hello and Happy December everyone! Suz here with you to start off our Chic Tags Twelve Days of Christmas holiday merrymaking. I decided to start this party off right with a few Christmas cards created with this year's crazy adorable Christmas Cheer Exclusive Kit available to purchase here (while supplies last!) as well as some goodies from the Good Tidings collection. I figured there miggggght just be a few of you getting started on them, yes? And that is ok. I am here to help you get started!! :)

I loved pairing the Good Tidings "Frost" patterned paper with bits and pieces from the kit on this first card below.

The belt buckle was made with a bit of black card stock and some American Craft green glittered trim.


This adorable little snowman below commanded special attention, so I used a circle punch to make a window in the green chevron tag included in the kit. A few pop dots were added to give the card a bit of dimension. Add a little sentiment tag and some machine stitching and the card is done! Easy peasy!

Né sous les meilleurs auspices, ce jeune homme d’à peine 20 ans, né dans la petite ville de Palestine (État du Texas), d’un père chauffeur chez UPS et d’une mère qui tient son salon de coiffure, intègre le système scolaire indépendant d’Elkhart, bourgade située au nord de Houston, dès son plus jeune âge. Il semble donc prédestiné à rencontrer les Terrence Mallick (excusez du peu) et autres Jeff Nichols, qui lui permettront de faire ses premières armes au cinéma. C’est avec le réalisateur de Badlands (1973) et de La Ligne rouge (1998) qu’il obtient son premier rôle dans The Tree of Life: l’Arbre de vie. Et si le film sort sur les écrans en 2011, année où il obtient la Palme d’or au festival de Cannes, le tournage a lieu 3 ans auparavant, en 2008 donc. Tye n’a que 11 ans à ce moment-là et il est choisi parmi environ 10 000 gamins de son âge venus comme lui tenter leur chance pour le casting. Il s’agit pourtant de sa toute première audition, mais sa capacité à improviser devant la caméra convainc l’équipe de tournage. Il fait alors ses débuts aux côtés de Brad Pitt et de Sean Penn. De quoi impressionner un novice aussi jeune! C’est cette fois-ci à l’acteur chevronné Matthew McConaughey (Killer Joe, Dallas Buyers Club, True Detective) qu’il donne la réplique. Impressionnant de maîtrise dans son jeu, il dresse le portrait d’un adolescent en mal de modèle masculin à la recherche de son identité, transitant de l’amour filial au désir amoureux en passant par le sentiment amical et/ou fraternel, généreux et fougueux tout à la fois, émouvant de naturel, une révélation qui le conduit à endosser l’année suivante le rôle de Gary dans l’adaptation du roman de Larry Brown par David Gordon Green: Joe (2013). Ado paumé au tempérament farouche, à qui la vie n’a pas fait de cadeau, recueilli par un Nicolas Cage retrouvé, en père de substitution au caractère bourru mais profondément humain. C’est la confirmation d’un grand espoir du cinéma international qui est né. 

Détour par la série B



Comme beaucoup d’autres acteurs adolescents de son âge, appelés à figurer dans les teen-movies, films d’horreur, fantastique ou autres thrillers, il est aussitôt sollicité par le cinéma de genre, et décide d’accepter la proposition qui lui est faite par le réalisateur français Gilles Paquet-Brenner (Les Jolies choses, Elle s’appelait Sarah), qui signe désormais tous ses films aux États-Unis, de tourner dans l’adaptation du roman de Gillian Flynn, Dark Places (2015), aux côtés de l’actrice Charlize Theron (The Yards, Le Sortilège du Scorpion de Jade, La Légende de Bagger Vance, La Route entre autres), et, la même année dans Manuel de survie à l’Apocalypse zombie (2015) de Christopher Landon. Ce qui ne l’empêche pas de faire preuve de perspicacité dans ses choix de films et de compléter encore la palette de ses talents d’acteur. Car malgré un titre aux connotations grand-guignolesques, Manuel de survie à l’Apocalypse zombie surprend agréablement, se jouant des codes du film de série B (le budget avoisine “seulement” les 15 millions de dollars) et alliant un humour potache aux effets horrifiques les plus sanguinolents dans la lignée manifeste du désormais culte Shaun of the Dead (2004) d’Edgar Wright, offrant à l’acteur un rôle improbable de scout aux prises avec la population zombifiée de sa ville, prêt à tout pour sauver l’humanité, plein de fraîcheur naïve et quelque peu emprunté dans ses culottes serrées mais déterminé à franchir le pas qui le sépare symboliquement de la maturité en accédant au statut de héros de la communauté. Intelligent et réjouissant au possible. 

Retour au thriller (après Dark Places) avec Détour (2016) du réalisateur britannique Christopher Smith, en étudiant de droit brillant impuissant face à l’agonie de sa mère et qui se laisse embringuer dans une histoire rocambolesque sur fond de conflit avec son beau-père, de gangsters hirsutes et tatoués, vraiment méchants, qui se terrent au fond du désert, de tueur cocaïné à la gâchette facile, de drogue, d’alcool, de rave party et de filles ... tellement invraisemblable qu’on s’y laisse entraîner en dépit de tout. Une copie cependant assez pâle du meilleur de Guy Ritchie (Arnaques, crimes et botanique, Snatch). Encore une fois, Tye Sheridan, impeccable de professionnalisme, tire son épingle du jeu et s’en sort avec les honneurs.

La consécration hollywoodienne



Les prestations du jeune homme ne pouvaient ainsi échapper à la vigilance des studios hollywoodiens, toujours avides de recruter de nouveaux talents afin de renouveler leur galerie d’acteurs, et plus particulièrement de la Twentieth Century Fox, à la production du dernier volet des X-Men (inspirée de la série de comics du même nom publiée par Marvel et créée par Stan Lee et Jack Kirby), dont elle possède la franchise, le neuvième (rien que ça!): X-Men: Apocalypse (2016). A la direction: Bryan Singer (Usual Suspects) qui rempile bien sûr. Et bien qu’il s’agisse d’une proposition qui ne se refuse pas, il s’agit bien, à l’en croire, d’un choix artistique de sa part. Il assure en effet que de tous les films de super-héros, la série des X-Men est une des rares à “traiter de problèmes et de questions qui intéressent le monde actuel par lesquelles on peut se sentir concerné, si bien qu’on est amené à s’investir dans le personnage qu’on joue et à s’impliquer émotionnellement” (traduction d’une interview de Tye Sheridan donnée au magazine Independent du 17 juin 2016, assurée par Jacob Stolworthy). Tye Sheridan y incarne le rôle de Scott Summers, dit le Cyclope, du nom de son personnage de mutant dans le film, son super pouvoir consistant à faire jaillir des rayons laser de ses yeux. D’où une paire de lunettes noires qu’il chausse pour l’occasion: simple accessoire de tournage ou symbole de son nouveau statut de star hollywoodienne? En effet, le jeune homme, après avoir réussi son audition devant “le maître”, rejoint Steven Spielberg fin juin 2016 sur le tournage de son prochain film dont la sortie est prévue en 2018., alors qu’il fut question un temps que le rôle soit confié à Nick Robinson (The Kings of Summer, critique du film sur Cinechronik’s: ici, Being Charlie). Ready Player One nous conte l’histoire d’un univers virtuel nommé l’Oasis dans lequel des millions de joueurs se lancent afin d’y trouver les trois clefs cachées qui permettront à leur détenteur d’hériter de toute la fortune de son créateur. Tye Sheridan y tiendra le rôle principal (!), celui de Parzival alias Wade Owen Watz, adolescent de 17 ans lui-même en quête du trésor. 

Fulgurante carrière que celle de ce jeune texan d’à peine vingt ans issu d’une petite ville perdue des États-Unis à qui les parties de pêche qu’il pratiquait dans son enfance au bord du lac en compagnie de ses amis doivent sembler bien loin. Et pourtant, il ne lui aura fallu que cinq ans pour gravir un à un les échelons qui l’ont mené aux sommets de Hollywood. Cependant, le jeune homme avoue son envie de toujours apprendre, que ce soit dans le cadre scolaire, qu’il a dû plus ou moins laisser de côté, ou sur un plateau de tournage où il n’a de cesse d’observer et de poser des questions aux professionnels qui l’entourent: “ [...] je passe des heures précieuses en dehors du plateau ou derrière la caméra avec des réalisateurs, des producteurs et des acteurs incroyables. C’est super de simplement pouvoir avoir une conversation avec eux et de leur poser des questions.” (Independent, 17/06/2016, op. cit.). La simplicité alliée à la maturité du garçon semblent devoir le préserver, espérons-le, des pièges qui guettent tout jeune acteur monté trop haut un peu trop vite dans le milieu du spectacle et projeté soudainement sur le devant d’une scène médiatique impitoyable. Les exemples ne manquent pas de ceux qui s’y seront brûlé les ailes (River Phoenix, Edward Furlong, Corey Haim, ...). D’autant plus qu’il y aurait beaucoup à y perdre pour les spectateurs de cinéma que nous sommes (on se calme, les filles ...). Espérons aussi qu’il n’oubliera pas de sitôt le circuit indépendant du cinéma d’où il vient et grâce auquel, en sus de son talent indéniable, il lui est donné aujourd’hui d’accéder au monde des paillettes et du star-system. Don’t sleep Tye ...

 Now the logo is very abstract and unrecognizable. The logo changes and the cars become more conforming though the Cactus model has a few unlikely features.
Is it still smooth and comfortable? 
A comfortable ride has something going for it after noticing the rough ride that goes with some cars.
I know a certain medium sized van with a certain wheel base that requires certain calculations to turn and simply drive straight into the parking in a shopping centre and rarely is it just right. A minor problem really.

          直播到哪里 党建就到哪里   

6月30日,斗鱼"网红党支部"在武汉成立,在网络直播行业旗帜鲜明地加强非公经济基层党组织建设。全国500多家直播平台中这个"网红党支部"系首家,直属斗鱼党委,已有18名网络主播党员。斗鱼CEO张文明:直播到哪里,党建就推进到哪里。

在全国500多家直播平台中,这个"网红党支部"系首家,直属于斗鱼党委,已有18名网络主播党员。去年5月,斗鱼刚成立党组织时,党员人数为65人。经过1年发展,党员人数增加到178人,占员工总数的一成多。

武汉实施"红色引擎工程",党员成为群众身边最具活力的"红色细胞"。"艾媒咨询"提供的数据显示,2017年中国直播平台用户接近4亿人,占网民总量的比例超过了五成。目前,斗鱼注册用户超过1亿人。

斗鱼公司CEO张文明表示,全力支持在斗鱼建立党组织,直播到哪里,党建就推进到哪里。"90后"的斗鱼"网红党支部"书记古娜说,斗鱼一直在争做直播行业的党建试验田。"网红党支部"成立后,将通过直播不断建设一个风清气正的网络空间。

"我眼中的党员精神是用直播把日常的好人好事传播得更广。""蓝胖儿"说,"最近一场有关'唱红歌'的党建直播活动,48小时吸引105万多人次观看。"今年6月,斗鱼开始大规模直播先进党员事迹,从武汉起步,陆续覆盖全国。

编著过《激越30年》一书的华中科技大学教授王溥认为,光谷是武汉非公经济最活跃的地方,斗鱼在党建方面的探索具有极强的示范和带动作用。

          今天你们健身了吗?   

6月29日,新华社一篇报道称山西屯留县岭上村曾是有名的"百人上访村",直到村里建了广场、搞了锣鼓队,一些上访者才慢慢醒悟过来:现在的日子不知比原来好了多少,在体育锻炼中找到了自身的价值与意义。

曾经,山西省屯留县岭上村是个有名的"百人上访村",而今,这里的村民更多是聚集在健身广场上,以打球、跳广场舞等方式娱乐、锻炼。在一些老区基层,全民健身正成为农村治理的新"密码"。

屯留县位于晋东南的上党盆地西侧,著名的上党战役主战场就在这里。近年来,这个被誉为"中国体育人第二故乡"的红色老区以全民健身为抓手,体育产业发展迅速。

2015年,冯斌来到岭上村时,"全民健身"的风潮正席卷全国,而屯留县则走在了前端。乘着屯留推广全民健身的"东风",作为村第一书记的冯斌于2016年带领村民修建了一块3000平方米的健身广场,安装了篮球架、平步机等配套器材,岭上村百姓有了自己的健身娱乐场所。

广场的建成极大地激发了村民的健身热情,每到傍晚,村里的男女老少就会聚集在广场上,打篮球、踢毽子、跳广场舞等,热闹非凡,夏天人最多的时候,有百余人同时在此锻炼。

此外,在村委会的支持下,村民组织了一个锣鼓队,吸纳了50多位热爱跳舞的妇女,利用闲暇时间进行训练,还时常外出表演。

锣鼓队队长吴晚凤曾是村里的上访大户、有名的"刺儿头",数次去过省城太原上访。

"当初鬼迷了心窍,觉得自己搬迁吃了亏,平常没事干就去上访。"回忆起当初上访的情景,45岁的吴晚凤略显尴尬。她说以前自己钻了牛角尖,整天只想着闹事,直到村里建了广场、搞了锣鼓队,她才慢慢醒悟过来,现在的日子不知比原来好了多少。

吴晚凤说她如今才真正学会享受生活,而每日的广场舞和锣鼓训练就是她快乐的源泉。"住上了新楼房,过上了好日子,每天有事忙,生活充实了,心情也好了,自然就想开了。"她告诉记者,许多乡亲都跟自己一样,在体育锻炼中找到了自身的价值与意义。

不光如此,随着体育锻炼火遍全村,村民间的关系也得到了极大改善。

吴晚凤告诉记者,如今村里人说闲话的少了,相互关心的多了。年前她得了场大病,乡亲们纷纷相助,捐钱的捐钱,出力的出力,让她十分感动。"如果我没有和大家一起跳舞,我想不会有这么多人关心我,在乎我。"她说。

"以全民健身为抓手化解农村矛盾,效果超乎想象。"冯斌说。实际上,随着山西省28200个行政村体育场地和1196个乡镇全民健身广场"两个全覆盖"的实现,健身已经成为基层农村治理的新"抓手"。

<span class="paragraphSection">In January and February 1939 three vast banners featuring the monumental image of a domestic worker were suspended from the imposing portico of the Grand Palais, Paris, as more than six hundred thousand people passed beneath on their way into the sixteenth annual <span style="font-style:italic;">Salon des arts ménagers</span> (<span style="font-style:italic;">SAM</span>).1<sup>1</sup> The March 1939 (<a href="#kcx002-F1" class="reflinks">Fig. 1</a>) cover of the <span style="font-style:italic;">SAM</span>’s official magazine, <span style="font-style:italic;">L’Art ménager</span> (1927–1939), featured the photograph of an abundant and expectant crowd of bourgeois entrants dwarfed by one of these banners.2<sup>2</sup> Once inside the Grand Palais visitors were able to purchase five-franc exhibition tickets, plus catalogues, each printed with the same domestic figure.3<sup>3</sup> Composed of the most fundamental of geometric shapes, from a spherical head, rectangular torso, and chevron arms (without hands) to the insistent arc of a skirt that makes the otherwise abstracted figure’s feminine identity explicit, the domestic worker stands proud. Frontal facing with one imaginary hand on hip, the other bearing a broom in the manner of a standard, one might consider this a public female allegory for the mid-twentieth century. In attributing to femininity an illusory political authority, the figure is comparable to Paul Moreau-Vauthier’s haute-couture <span style="font-style:italic;">Parisienne</span> crowning the monumental gateway to the 1900 Exposition Universelle, or any number of examples one might draw from the preceding century’s state-commissioned Marianne statuary.           Anti-capitalism must feature at hikoi against asset sales   


Anti-capitalist: Why the ‘C’ word needs to feature as part of the hikoi against asset sales


Starting this week, a nation-wide hikoi is leaving the far north and traveling to Wellington carrying a raft of messages to the government. These include opposition to state asset sales, opposition to the Trans-Pacific Partnership Agreement (TPPA) and opposition to expansion of resource extraction (e.g. off-shore oil drilling, fracking, gold and coal mining). There is considerable appropriateness in bundling these issues together, and the opponents of these issues see them as interrelated. Briefly put, the linkage stems from a view that the country is being sold-out to multinational corporations with little or no benefit accruing to the people, and with negative social, political, economic and environmental consequences. It is hard to overstate the validity of these concerns.

However, absent most of the discourse about these issues is what lies at the heart of all of them: capitalism, in particular neo-liberal capitalism. The failure to direct our analysis to the root cause of these myriad social, economic and environmental issues will allow a further strengthening and entrenching of it.


Neo-liberal capitalism – or neo-liberalism in shorthand – is characterised by the privatisation of public assets; deregulation of trade, finance, investment, education and healthcare by nation-states in favour of trade management through a global rules-based system; the growth of multinational financial institutions (such as the IMF and World Bank); the rise of foreign direct investment; the development of intellectual property as a commodity, and a focus on individualism and societal atomisation. Indeed, neo-liberalism has been called ‘capitalism with the gloves off’ because business forces are stronger and more aggressive, and they face less organised opposition than ever before.[1]
This description fits well with the general thrust of the National Government’s political agenda. In reality, however, it is not so different from that of the previous (and potentially next) Labour government. This is why a debate about the more fundamental organization of our economic, political and social systems must be had. This is why we need to talk about capitalism.

Déjà vu?

New Zealand has already been subject to the extremes of neo-liberal capitalism under the fourth Labour Government and its successor in the 1990s National Government. Under Helen Clark, some of the worst excesses of the neo-liberal capitalist polices were abandoned (like private prisons and charter schools), but in other ways, neo-liberalism became even more deeply embedded into the political, economic and social fabric of New Zealand life. One of the best examples is the vigour with which the Clark government negotiated free-trade agreements and significantly relaxed Overseas Investment Commission oversight of foreign land and asset buying.

New Zealand society and social life has been transformed in the past 30 years. In particular there is a discernable shift from collective responsibility for social issues to individual responsibility. Health care and higher education, once viewed as a right and a collective good respectively, are now sold to us as an individual benefit, the cost of which must be borne individually. As a two-time Victoria University student, I was aghast at the ease with which the University Council raised student fees again and again against significant student protest when they had themselves been the beneficiaries of completely free university degrees.

Capitalism has no country

Part of the uproar about the National government’s approach is simply the brazenness with which it is being carried out. Key makes no apologies to those who don’t embrace his worldview: exacerbating the gap between rich and poor by making the rich richer, blaming the poor for being poor and if possible criminalising them at the same time.

Yet, what is critical for us to understand is that while Key’s approach is utterly odious to those of us who seek a more just world, it is simply part and parcel of capitalism. A government, any government, which operates a capitalist economic system operates a system of unavoidable injustice. That is the very nature of capitalism: it is the theft of the labour of the working class and the transfer of that wealth to the owning class.

The dominant feature of neo-liberal capitalism in the past 40 years is the growth in power of multinational corporations. Again, it is difficult to overstate the power exerted by corporations on the political and economic choices made by nation-states. It is now reportedthat more than half of the 100 largest economies in the world are corporations. Corporations such as Exxon, Chevron, General Electric, and Walmart have revenues that far outstrip New Zealand’s entire gross domestic product.
While these corporate names may strike you as decidedly American, a number of very well known ‘kiwi’ brands equally well meet the definition of a multinational corporation (i.e. they are a corporation with 25% or more foreign ownership). Included among these are the Bank of New Zealand, Skycity Entertainment Group, Contact Energy and Telecom.

The long and short of it is that the location of ownership is irrelevant; there is no such thing as ‘Chinese capital’ or ‘New Zealand capital’; there is money. The overriding impetus of corporations is to maximise profits. Local corporations exploit the environment and workers just like multinational ones do. The fight shouldn’t be about domestic or foreign ownership; the fight should be about ownership full stop. This is why a fundamental alteration to capitalist economics is so necessary.
In order for us to consider what other ways we can be in the world we must recognise first and foremost that the system is rigged. It is a system reliant on exploitation and inequality. If we don’t want those things then we are going to have to try something else. The first step is to re-introduce the critical discourse about capitalism to the forefront of our struggles; only then we will be able to more clearly see where power lies, and what avenues are available for change.
